EU commission attempts to break/bend law to please USA

So it turns out that the EU’s capitulation to the US on putting biometric data into passports is illegal – the Nice treaty specifically prevents the EU taking action on the issue of standardising passports. So now EU officials are working feverishly to create a loophole in the very clear ban that they themselves designed.
On a side note, the article notes the current visa waiver for EU citizens. If biometrics are not included, soon, in EU passports the US plans to fingerprint and photgraph all EU citizens entering the US. The ‘indignity of forced fingerprinting’ referred to is, of course, already in place for those, like myself, who do need a visa, and of course for those from many other countries. And, obviously, including biometrics in the passport will just move the ‘forced fingerprinting’ to the passport-issuing authority and displace contempt for and anger at the US government.
